Terms of Service

Last Updated: May 14, 2026

1. Agreement to Terms

By accessing our website at irrivive.com, contacting us, requesting a quote, scheduling, or receiving services from Irrivive LLC ("Irrivive," "Irrivive," "Company," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms of Service, please do not access our website or use our services.

These Terms of Service apply to all visitors, leads, customers, and others who access our website, contact us, or receive services from us.

2. Services

Irrivive LLC provides residential irrigation and sprinkler repair services in Parker, CO and surrounding communities, including but not limited to: sprinkler head repair and replacement, system diagnostics and inspection, seasonal start-ups, fall winterization, irrigation line and leak repair, valve repair and replacement, smart controller installation and programming, and high-efficiency nozzle upgrades.

All services are subject to availability and scheduling. We reserve the right to decline any service request at our sole discretion. Unless otherwise agreed in writing, services are provided for residential properties only.

Irrivive is not an emergency service provider. We do not guarantee same-day or after-hours availability. For water emergencies such as major pipe breaks or flooding, contact your water utility, a licensed plumber, or emergency services.

Irrivive LLC is a sole-operator service. When you book with us, you are working directly with the owner. We do not subcontract work to third-party crews without your prior knowledge and consent.

3. Estimates & Pricing

All estimates are based on information available at the time of assessment. Estimates are not binding guarantees of final price. Final pricing may vary based on actual scope of work discovered on-site, including hidden damage, existing system defects, system complexity, water pressure or soil conditions, parts availability, or required access issues not apparent during the initial assessment.

We will communicate any material changes to estimated costs before proceeding with work beyond the original scope. We will not perform additional work without your knowledge and verbal or written authorization. However, we cannot always foresee every condition prior to beginning work.

Published pricing on our website (if any) is provided for general reference only and is not a guaranteed quote. Quoted prices are subject to change based on current parts availability and supplier pricing.

4. Scheduling, Cancellations & Weather

Appointments are subject to availability. We request at least 24 hours' notice if you need to cancel or reschedule. Repeated last-minute cancellations or no-shows may result in a trip or cancellation fee, or we may decline to schedule future appointments.

We reserve the right to reschedule appointments due to weather conditions (including rain, lightning, extreme cold, or hazardous conditions), equipment issues, illness, or other unforeseen circumstances. In such cases, we will notify you as promptly as possible and work to reschedule at a mutually agreeable time. We are not liable for delays or rescheduling caused by weather or conditions outside our control.

You agree to provide timely access to your property and irrigation system at the scheduled appointment time. If we arrive and cannot access your property or system, a trip fee may apply.

5. Payment

Payment is due upon completion of services unless otherwise agreed in writing prior to the service appointment. We accept cash, check, and major credit cards. Accepted payment methods may change from time to time.

Invoices not paid within 30 days of the invoice date may be subject to a late fee of 1.5% per month (18% annually) on the outstanding balance, or the maximum rate permitted by applicable Colorado law, whichever is less.

Returned or dishonored checks are subject to a returned-check fee in the amount permitted by Colorado law. In the event of non-payment, we reserve the right to pursue collection through lawful means, including use of a collections agency or legal action. You agree to pay all reasonable costs of collection, including attorney's fees and court costs, to the extent permitted by law.

You are responsible for any applicable local, state, or federal taxes, fees, or surcharges associated with services provided by Irrivive LLC.

6. Property Access & Customer Responsibilities

You agree to provide safe, clear, and reasonable access to all areas of your property necessary to perform the requested services, including irrigation controllers, main shutoff valves, backflow preventers, valve boxes, all sprinkler zones, and any other components required to complete the work.

Underground utilities and private lines: You are responsible for disclosing any known underground utilities, private irrigation lines, electrical conduits, drainage pipes, invisible fencing, or other buried features that may be in the work area. Colorado law requires notification to the Utility Notification Center of Colorado (UNCC / 811) before digging. While we take reasonable precautions, Irrivive LLC is not responsible for damage to unmarked, unknown, privately-installed, or improperly marked underground utilities, lines, or structures. Notification to 811 does not cover private lines (e.g., sprinkler lateral lines, low-voltage wiring) that are not registered with a utility.

Pre-existing conditions and system defects: You acknowledge that irrigation systems may have pre-existing defects, age-related deterioration, incorrect prior installation, or conditions that are not apparent until work begins. Discovery of pre-existing conditions during service may require additional work and cost. Irrivive LLC is not responsible for pre-existing conditions or for issues that arise from the condition of your existing system, soil, water pressure, or property.

Landscaping and surface disturbance: Some repair work may require digging, trenching, or disturbance to lawn, landscaping, mulch, or ground cover. We will take reasonable care to minimize disturbance, but we are not responsible for restoring grass, landscaping, or surface materials to their prior condition unless specifically agreed in writing as part of the scope of work.

You agree to ensure that pets are secured and children are kept away from work areas during service visits for the safety of all parties.

Age requirement: You must be 18 years of age or older to opt in to SMS communications from Irrivive LLC. By checking the SMS consent checkbox on any of our forms, you confirm that you meet this age requirement.

Consent is not a condition of purchase or service. Your consent to receive text messages is entirely voluntary and not required to schedule or receive services from Irrivive LLC.

No sharing of SMS opt-in data for marketing: Mobile opt-in data and consent will not be sold, rented, shared, or disclosed to third parties, affiliates, or lead generators for marketing or promotional purposes. Information may be shared only with aggregators and providers of the text messaging services used to deliver our messages, and only as necessary to provide those services.

For more information on how we handle your data, see our Privacy Policy.

8. Warranty

We stand behind our workmanship. If you experience a failure directly related to a repair we performed, contact us within 30 days of the service date and we will assess the situation and correct qualifying issues at no additional charge.

Warranty coverage is subject to the following limitations:

  • Warranty applies only to the specific repair or installation performed by Irrivive LLC during that service visit.
  • Warranty does not cover unrelated system failures, separate zones, or components not part of the original repair.
  • Warranty does not cover damage caused by freezing temperatures, improper winterization by others, freeze-thaw cycles, acts of nature, vandalism, or circumstances beyond our control.
  • Warranty does not cover pre-existing conditions, defects present before our service, or damage caused by other contractors, improper DIY repairs, or neglect.
  • Warranty does not cover normal wear and tear on components with a limited service life (e.g., soaker hoses, aging valves, or aged sprinkler bodies).
  • Parts warranties are governed by the terms of the parts manufacturer and may differ from this service warranty.

EXCEPT AS EXPRESSLY SET FORTH IN THIS SECTION, ALL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IRRIVIVE LLC AND ITS OWNER, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SERVICES, THESE TERMS, OR YOUR USE OF OR INABILITY TO USE OUR WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO IRRIVIVE LLC FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS PRECEDING THE EVENT.

We are not liable for, and expressly disclaim responsibility for:

  • Pre-existing conditions or defects in your irrigation system or property.
  • Damage caused by other contractors, improper DIY repairs, water pressure fluctuations, or soil conditions.
  • Issues arising from normal wear and tear or end-of-life components.
  • Damage caused by freezing temperatures, drought, flood, acts of God, or other weather events.
  • Damage to unmarked, privately installed, or improperly marked underground utilities or structures.
  • Delays or inability to provide services due to weather, illness, equipment failure, or other circumstances outside our control.
  • Loss of use, loss of water, landscaping damage arising from the failure of your irrigation system before, during, or after service.

10. Indemnification

You agree to indemnify, defend, and hold harmless Irrivive LLC and its owner, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to: your use of our services; your violation of these Terms; your failure to disclose known property conditions, underground utilities, or access restrictions; your violation of any rights of a third party; or any inaccurate or misleading information you provide to us.

11. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall first be subject to good-faith written notice and negotiation between the parties for a period of at least 30 days. If the dispute cannot be resolved through negotiation, it shall be resolved through binding arbitration administered in Douglas County, Colorado, in accordance with the rules of the American Arbitration Association (AAA) then in effect. Judgment on any arbitration award may be entered in any court of competent jurisdiction.

Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for matters where such relief is appropriate.

12. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time, at our sole discretion. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of your rights and obligations.

13. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Irrivive LLC regarding your use of our website and services, and supersede all prior and contemporaneous agreements, understandings, negotiations, and representations, whether written or oral, relating to the subject matter herein.

15. Attorney Review Recommendation

Note: These Terms of Service are provided for general business purposes and do not constitute legal advice. The limitation of liability, warranty, cancellation fee, dispute resolution, and payment collection provisions may carry specific legal implications under Colorado law. Before relying on these terms for enforcement, Irrivive LLC recommends review by a licensed Colorado attorney.
